Terms and conditions mountaineering school

1. Booking deadline
Each trip has a booking deadline. If the trip is still not fully booked, signing up is also possible later on.

2. Cancellation by the customer
If the customer cancels a booking, he shall pay a service charge of CHF 50.00. In addition, the following charges will apply:
• 30 -21 days prior to departure 50% of trip price
• 20 - 10 days prior to departure 75% of trip price
• 9-0 days prior to departure 100% of trip price

If the customer can only participate to a limited extent, there is no pro-rata refund.

We recommend all customers to take out cancellation insurance. Such insurance will cover the costs resulting from a booking cancellation by the customer. This insurance can be taken out with grindelwaldSPORTS.

Tours outside the Alps
For trips outside the Alps, separate booking conditions apply.

3. Cancellation by the organizer
For most activities, there is a booking deadline and a minimum number of participants. If the minimum number of participants is not met, grindelwaldSPORTS is entitled to merge groups or cancel the trip. A trip can still be run if customers agree to to pay additional costs caused by a lack of participants.

4. a Cancellation before the start of the trip
If weather and environmental conditions, governmental interventions, acts of God, security or other reasons severely complicate, endanger or make the activity impossible, grindelwaldSPORTS is entitled to cancel the activity or change the area. Cancellations will be communicated to the customer immediately. In case of cancellation by the organizer (grindelwaldSPORTS AG) the amount paid will be refunded.

4. b Changes and cancellation during the trip
If weather and environmental conditions, governmental interventions, acts of God, security or other reasons severely complicate, endanger or make the activity impossible, the mountain guide- with mutual agreement with the customer- is entitled to modify or even cancel tour. There is no reimbursement entitlement.

Should the tour be canceled or altered due to lack of fitness or illness there is no reimbursement entitlement.

5. Image material
grindelwaldSPORTS AG reserves the right to use images, which were taken during the trip by the mountain guides or participants, for print products, web site and picture galleries. Individuals may be recognizable in the picture material. The customer agrees to that and is not entitled to any compensation.

6. Insurance
Insurance is the responsibility of the participant. grindelwaldSPORTS recommends that all customers take out comprehensive accident and health insurance covering the booked activity.

7. Liability
grindelwaldSPORTS exclusively contracts mountain guides approved by the International Federation of Mountain Guides Associations (IFMGA) to manage and run a trip or training course on their own responsibility. Additionally, and with the consent of the contracted mountain guide, carefully selected aspirant guides, who are able to cope with the specific requirements and are approved by the Swiss Mountain Guides Association (SBV) will be employed to assist the mountain guides in the running of a training course or guiding a trip.

To manage and run a trip or training course on their own responsibility up to and including alpine grade F (easy) in difficulty, aspirant guides approved by the Swiss Mountain Guide Association (SBV) can be contracted.

In accordance with the legal requirements grindelwaldSPORTS does not assume any liability for damages that the customer may experience caused by negligence or willful misconduct of the contracted mountain guide or aspirant guide. In addition, liability for ordinary or moderate negligence in the selection and instruction of the mountain guide or aspirant guide, is excluded (Art. 399 para 2 CO).

All of the mountain guides and aspirant guides contracted by grindelwaldSPORTS to run a trip or training course have a professional liability insurance. By signing, the customer agrees, that any claims for compensation need to be asserted primarily against the guide and his professional liability insurance respectively.

8. Jurisdiction
The exclusive venue of jurisdiction is Interlaken. All disputes are subject to Swiss law.
